“Application” means any Mixconix software application you acquire via SAP Store or Order Form, together with its Documentation and updates. “Customer Environment” means your SAP BTP subaccount(s) or infrastructure where the Application is deployed. “Mixconix Environment” means infrastructure operated by or for Mixconix if a hosted/SaaS option is offered.
Subject to payment and compliance, Mixconix grants you a limited, non‑exclusive, non‑transferable, non‑sublicensable, revocable license to deploy and use the Application within the Customer Environment for your internal business purposes.
Default: Customer‑managed SAP BTP (you manage users/roles, connectivity, and configuration). If Mixconix provides hosting, additional service terms may apply.
You shall not: (a) copy except for backup; (b) reverse engineer except as permitted by law; (c) sublicense, resell, or provide to third parties; (d) use for unlawful purposes or benchmarking; (e) remove proprietary notices; (f) interfere with security or usage limits.
Some Applications may call external services (for example, government validation APIs or banking validators). Such services are outside Mixconix control; availability or accuracy is not warranted. Where Mixconix processes personal data in connection with such calls on your behalf, the DPA applies; some services (e.g., EU VIES) may act as independent controllers for their validation function.
The Mixconix DPA governs processing of personal data on your behalf and prevails over this EULA for data‑protection matters. The Mixconix Privacy Policy applies to general interactions.
Mixconix maintains ISO 9001 and ISO/IEC 27001 certifications. Technical and organisational measures are described in the DPA. You are responsible for security settings in the Customer Environment.
Support Hours: Monday–Friday, 09:00–18:00 (EET/EEST). Channels: support@mixconix.com; escalation: office@mixconix.com. SLA Targets (within Support Hours): P1 response 4h; P2 response 8h; P3 response 1 business day. Updates/patches may be provided and will not materially reduce core functionality.
Fees are set in SAP Store or the Order Form and exclude taxes. For on‑prem/customer‑managed deployments, Mixconix may request reasonable information to verify compliance with license scope.
The Application is licensed, not sold. All rights not expressly granted are reserved. You grant Mixconix a non‑exclusive, royalty‑free license to use feedback. Open‑source components are licensed under their respective licenses; any conflict is resolved in favour of the open‑source license for that component.
EXCEPT AS EXPRESSLY STATED IN THE ORDER FORM, THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE". MIXCONIX DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIXCONIX IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS INTERRUPTION. MIXCONIX’S TOTAL LIABILITY IS LIMITED TO THE FEES PAID FOR THE APPLICATION IN THE 12 MONTHS PRECEDING THE EVENT.
This EULA applies for the subscription term. Either party may terminate for material breach not cured within 30 days of notice. Upon termination, you must cease use and remove the Application.
You will comply with applicable export controls and sanctions.
SAP is not a party to this EULA. Order of precedence for conflicts: DPA (data protection) → SAP Store terms / Order Form → this EULA → Terms & Conditions → annexes/policies.
Support Hours: Monday–Friday, 09:00–18:00 (EET/EEST), excluding Romanian public holidays.
SLA Targets:
P1 response 4h; workaround 1 business day; target resolution 2 business days.
P2 response 8h; workaround 2 business days; resolution in next maintenance.
P3 response 1 business day; resolution in planned release/knowledge article.
Customer provides masked logs and a test environment when feasible.
